Bad Faith

« Back to Practice Areas

The firm handles all aspects of both first- and third-party extra-contractual liability claims for its clients, including issues relating to Commercial General Liability and Property policies, Personal Automobile and Homeowners policies, Professional Liability policies, and Directors and Officers policies.

We have successfully represented insurers in bad-faith actions in Colorado and Wyoming, in both state and federal court. Our attorneys are conversant with and understand the nuances of this kind of litigation, and provide their clients with experienced guidance through the discovery and motions practice attendant to these cases. Perhaps in no other area is the counsel provided to the client’s employees more vital to a positive resolution of the case, given the many pitfalls that can arise. Further, we are fully prepared to defend these cases through trial and, when necessary, on appeal, with a proven track record at both levels.

The firm’s bad-faith experience also benefits its clients through its use as a tool for litigation avoidance. Our significant experience in insurance coverage matters provides the foundation of our ability to quickly assess and understand allegations of insurance-claim mishandling, and the refusal to defend or indemnify. We provide advice to the insurance industry about claims-handling, and investigation practices, as well as policy interpretation to try to ensure that our carrier-clients can fulfill their obligations in a manner that will keep them out of the courthouse and above any charges of bad faith. Our attorneys consult with, and lecture to, insurance companies, including their in-house counsel and legal staff, on bad faith and insurance claims-handling issues and also continually monitor judicial, legislative, and regulatory developments to assure that our clients are notified immediately of any changes that may impact their or their insureds’ interests, whether positively or negatively.
